Even if a criminal record on your background report is yours, it must be reported with maximum accuracy. Details such as dates, dispositions, charge names, and offense levels must match the official court records. Any errors in reporting this information may be a violation of the FCRA.
Including sealed or expunged criminal records in commercial background checks is a violation of the FCRA. Additionally, dismissed or dropped cases can only remain on background reports for up to 7 years, while conviction records may be reported indefinitely under federal law.
