Right to Accurate Information

  • Consumer reporting agencies must ensure the information they report about you is 100% accurate and up to date.

Right to Be Notified

  • If someone takes adverse action against you (like denying a job or apartment) because of your background report, they must notify you and provide a copy of the report.

Right to Privacy & Consent

  • Employers, landlords, and others must get your written permission before running a background or credit check.

  • You also have the right to know who accessed your report and why.

Right to Dispute Errors

  • You can file a formal dispute with the background check company to correct inaccuracies.

  • They are required to investigate and respond within 30 days.

  • If they fail to fix the problem, you can take legal action.

Right to Sue for Damages

  • If a background check company or data provider violates your FCRA rights, you may be entitled to financial compensation.

  • You can recover damages for lost job opportunities, emotional distress, punitive damages and attorney’s fees.
